Hamilton County Common Pleas Court Judge Jody Luebbers ruled Tuesday that the doctor for Planned Parenthood of Southwest Ohio breached a legal duty by not having an informed consent meeting with a 14 year old girl 24 hours before performing an abortion on her.
The case, which has yet to begin its trial phase, involves a young girl known only as Jane Doe to protect her identity. She was involved in a sexual relationship with her 22 year old soccer coach John Haller when she was between the ages of 13 and 14. The coach, who has served three years in prison on charges of sexual battery, impregnated the girl in 2004 and sent her to Planned Parenthood.
Attorneys for the girl further allege that Planned Parenthood failed to alert officials of the possibility of abuse. This claim will be the sole subject of the case when it goes to trial in February. As proof, they assert that when the girl was asked for her parents’ phone number so Planned Parenthood employees could obtain their consent, she provided Haller’s number. Apparently no effort was made on the part of Planned Parenthood to confirm that they were actually speaking with the girl’s parents.
The girl’s attorneys also claim that Planned Parenthood follows a policy of doing as little as possible to get involved in cases like this and has found alleged written proof of a “Don’t Ask/Don’t Tell” policy when it comes to sexual abuse of minors. Planned Parenthood representatives say they report as required by the law, but recent investigations by Lila Rose of Live Action across the country show a clear pattern of ignoring cases of statutory rape.
The attorneys defending Jane Doe in this case are also fighting another case against Planned Parenthood of Southwest Ohio in which a teenage girl claims she told Planned Parenthood workers she was being sexually abused by her father, and they took no action.
