Who’s the Real Extremist on Roe v. Wade?

Chapman Fingers the Real Extremists

Steve Chapman in an August 4 Chicago Tribune Commentary asks, “Who’s the extremist on Roe vs. Wade?” He says in 1990 while working for Bush Sr., John Roberts signed a brief that said the court’s conclusion in Roe, that there is a fundamental right to abortion, finds no support in the text, the structure or the history of the Constitution. He wrote that Roe v. Wade flows from unprincipled jurisprudence and is an exercise of judicial power.

While we’re told that only an ultraconservative, anti-feminist zealot would say such things, the fact is many liberals as well as conservatives, have discovered as much. Archibald Cox wrote that neither historian, layman, nor lawyer will be persuaded that all the prescriptions of Justice Harry Blackmun are part of the Constitution. John Hart Ely said the Roe decision is not constitutional law and gives almost no sense of an obligation to try to be. Laurence Tribe said that behind its own verbal smokescreen the substantive judgment on which Roe rests is nowhere to be found. Even Ruth Bader Ginsburg criticized Roe, calling it an act of heavy-handed juridical intervention that ventured too far.

What’s striking, Chapman writes, is how many supporters of abortion have trouble justifying the way the court addressed the issue. So when Roberts faults the court for its overbearing presumption and lame reasoning, he is not on the fringe of the debate but smack in the middle of it.

Support for Roe Is Thin

But this can’t be said for abortion supporters. They not only insist that Roe is sacrosanct, but pretend that the public agrees with them. NARAL says surveys show that 65 percent of Americans support Roe. If you ask people if they would like to see Roe overturned, Chapman admits, the majority will say no. But that’s because they don’t know what Roe says.

And while they say they support it, they want limits and restrictions on abortion. They want a waiting period. They support parental consent. They want most abortions banned after the first trimester. A Gallup Poll shows 68 percent want abortion illegal in the second trimester and 84 per cent want it barred in the third trimester. But Roe demands abortion up to the day of birth. So it’s not 65 percent of Americans for Roe. It’s 84 percent against Roe.

Chapman concludes there’s no way to know if Roberts would vote to junk Roe. If Roe is overturned the whole mess goes back to the states, anyway. Chapman says that would be more democrtatic. The pro-aborts can’t even be honest in their panic. Thanks, Steve.

Abortionist Hern Unhinged

Warren Hern, abortionist from Boulder, CO bought a full page ad in the Boulder Daily Camera to lash out at “Operation Save America” in Boulder recently to picket his abortion mill and his home. The pro-lifers got Hern mad for leafleting his neighborhood with the truth about his grizzly business. The flyer says he has slaughtered thousands of innocent children and suggests that these neighbors should ask him to stop.

Hern, in a fit of unbridled rage, calls them terrorists who want someone to kill him, that they hate freedom and thought and even America, and that they are despicable, threatening, outrageous, cowardly, dangerous fascists who create fear, suspicion, intolerance, hatred, bigotry, repression and the destruction of a free society. Besides this, Hern says they are totalitarian, repressive, racist, witch hunters, anti-communist and the Taliban.

Wow! All that for asking his neighbors to pray for him. Would you say baby-killer Hern has gone off the deep end? Our hat is off to Flip Benham and Operation Save America. They must be doing something right.
